(the “Sweepstakes”) Official Rules

No Purchase or Obligation Necessary to Enter or Claim a Prize.

SWEEPSTAKES DATES:

The Sweepstakes begins on December 26, 2019 12:00 AM Pacific Time (“PT”) and ends at 11:59 PM PT on March 31, 2020 (the “Sweepstakes Period”). For purposes of this Sweepstakes, a “day” is defined as a 24-hour period, beginning at 12:00:00 AM PT and ending at 11:59:59 PM PT. The Sponsor’s computer, or that of its designee, runs the official clock for the Sweepstakes and will solely determine the time by which an entry is received.

ELIGIBILITY:

Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, who are eighteen (18) years of age or older at the time of entry and have an account on www.bulletproof.com (“you” or “Entrant”). Employees of Bulletproof 360, Inc, LLC (“Sponsor”) and its parent company, related subsidiaries and affiliated companies, prize suppliers, and advertising and promotion agencies and each of their respective agents, representatives, officers, directors, shareholders, and employees, and the immediate families (spouse, and parents, children and siblings, and their respective spouses regardless of where they live) (collectively “Releasees”), and individuals living in the same households, whether related or not, of the above, are not eligible to enter or win a prize. Each Entrant by participating in the Sweepstakes agrees to be bound by the Official Rules and that of the Sponsor’s decisions. Void outside of the United States, in Puerto Rico and where prohibited or restricted by law. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.

HOW TO ENTER:

To enter the Sweepstakes, complete the entry form by submitting your email address and testimonial on the applicable entry form at https://bulletproof.com/testimonials. By submitting your email address and testimonial to Sponsor, you agree to the bulletproof.com terms of use and privacy notice and to receive Sponsor’s newsletter and emails. To unsubscribe, follow the directions on emails received from Sponsor or in the privacy notice. Please note that if you unsubscribe before the end of the Sweepstakes Period, Sponsor will not be able to contact you should you be a winner.

Entry Limit:

One (1) entry per person per email account. The maximum entries per person per account during the Sweepstakes Period is one (1). Entries received in excess of the entry limit stated herein will be disqualified. Each entry submission must be manually key stroked and manually entered by the individual Entrant; automated and/or repetitive electronic submission of entries (including, but not limited to, entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from these accounts or related e-mail or IP addresses may be blocked. By submitting an entry, Entrant agrees to comply with the Sweepstakes Official Rules. Entries may only be submitted by a single Entrant. Entries that do not comply with these Official Rules, as determined in Sponsor’s sole discretion, will be disqualified from the Sweepstakes. Decisions of the Sponsor is final and binding.

RANDOM DRAWINGS:

A random drawing to select the first Grand Prize winner on or about March 10, 2020 and the second Grand Prize winner on or about April 10, 2020 (the “Drawing Dates”) from among all eligible entries received during the Sweepstakes Period. All drawings will be conducted by the Sponsor. Decisions of the Sponsor will be final and binding on all matters relating to this Sweepstakes.

PRIZE:

There is a total of two (2) grand prize winners. Total ARV of prizes: USD $4,200.00 ($2,100 each). Each Grand Prize includes $175.00 on-line in-store credit applied to the winner’s www.bulletproof.com store account on or about the first (1st) of each month for twelve (12) consecutive months for a total of $2,100 after the Grand Prize is confirmed between Sponsor and Entrant. ¬¬¬The odds of winning a prize depends upon the total number of eligible entries received during the prize period. In no event will more prizes be awarded than those listed in these Official Rules. Winner is responsible for the payment of all taxes on the prizes. All details of the prize not specified herein shall be determined solely by Sponsor and prize provider. Except as provided herein, no cash or prize substitution is allowed except at the discretion of Sponsor, who reserves the right to substitute a prize (or prize component) with one of comparable or greater value. If prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value will be awarded; provided, however, that if prize is awarded but unclaimed or forfeited by recipient, prize may not be re-awarded, in
Sponsor’s sole discretion. By accepting prize, Prize Winner acknowledges compliance with these Official Rules.

WINNER NOTIFICATION AND VERIFICATION:

The Sponsor will contact the potential Winner through the entry platform used to submit their entry. Notification will occur by direct message to the email submitted by Winner. Winner will be notified on or about the Drawing Date. The potential Winner will be required to respond to the direction in the message within 48 hours with full contact information. Potential Winner may be required to complete, sign, and return an Affidavit of Eligibility and Liability Release and; where legal, a Publicity Release (collectively the “Affidavit”). Complete document must be returned within three (3) days from prize notification date or the prize will be forfeited and awarded to an alternate potential winner. If a potential Winner (i) cannot be contacted after a reasonable attempt has been made by Sponsor; (ii) fails to timely return the required paperwork without alteration and in the form presented by Sponsor; (iii) refuses the prize; and/or (iv) the prize or prize notification is rejected or returned as undeliverable, such potential Winner forfeits all rights to be deemed a winner in the Sweepstakes and receive the Prize, and that potential prize winner will be disqualified and an alternate winner will be selected through a random drawing by the Sponsor from the remaining entries. Prizes must be accepted as awarded. Except where prohibited by law, the winner’s entry and acceptance of the prize constitutes permission for the Sponsor to use said winner’s name, photograph, likeness, statements, and biographical information without further compensation.

CONDITIONS OF ENTRY:

Use of any automated entry software is prohibited. Electronically reproduced, mechanically reproduced, illegible, incomplete or inaccurate entries are void. By participating, Entrants agree to comply with these Official Rules including all eligibility requirements. In case of a dispute as to the owner of an online entry, online entry will be deemed to have been submitted by the authorized account holder from which the entry is made. Caution: Any attempt by an Entrant or any other individual to deliberately damage any online service or web site or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made; the Sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision.

Sponsor, their affiliates, and licensees may use Entrants’ names, personal information, and statements made by Entrant to Sponsor and information on the entry form (“Submission”) for advertising and promotional purposes in all media worldwide without additional compensation. Entrant irrevocably grants to Sponsor the unrestricted right to edit, modify, use, publish, display, broadcast, distribute and copyright materials bearing Entrant’s name, voice, likeness and/or any other identifiable representation of Entrant, including, but not limited to, statements attributable to Entrant (“Entrant’s Likeness”). Entrant agrees that all material containing Entrant’s Likeness shall be and remain the sole and exclusive property of Sponsor, and Entrant hereby assigns any and all rights in or to such material to Sponsor and releases and forever discharges Sponsor from any and all claims, liabilities and damages relating to the use of Entrant’s Likeness. Entrant hereby waives any and all rights to inspect or approve Sponsor’s use of the Submission or Entrant’s Likeness, or any part or element
thereof.

LIMITATION OF LIABILITY:

Each of their respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from participation in the Sweepstakes or acceptance, possession, use, misuse or nonuse a prize (including any travel or travel-related activity thereto) that may be awarded. This Sweepstakes and these Official Rules shall be interpreted in accordance with the laws of the State of Washington without regard to its principles of conflicts of law. Jurisdiction and venue shall be solely within the State of Washington. Releasees are not responsible for technical, computer, mechanical, printing, typographical, human or other errors relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes related materials; or for stolen, lost, late, misdirected, damaged, incomplete, inaccurate, undelivered, delayed or illegible entries or; for electronic, computer, or telephonic malfunction or error, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, or process any transaction thereon. If in the Sponsors’ opinion, for any reason this Sweepstakes is not capable of running as planned, or there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer viruses, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the Sponsors reserve the right at their sole discretion to disqualify any individual (and void his/her entry and/or prevent him/her from future participation) who tampers with the entry process and/or who is acting in violation of these Official Rules, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and at Sponsor’s discretion conduct the judging to award the prize using all eligible non suspect transactions and entries received as of the termination date. As a condition of entering the Sweepstakes, Entrants agree that: a.) under no circumstances will Entrants be permitted to obtain awards for, and Entrants hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; b.) all causes of action arising out of or connected with this Sweepstakes, or the prizes awarded, shall be resolved individually, without resort to any form of class action; and c.) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and in no event shall Entrant be entitled to receive attorneys’ fees or other legal costs. Sponsor reserves the right to modify prize award procedures at their discretion.

WHO WON:

To request a list of winners, send an e-mail with subject line “Bulletproof #BeBulletproof Sweepstakes” to care@bulletproof.com. Requests must be received no later than April 15, 2020. The list will be sent when the drawing has been conducted and the winner verified.
